Defendants denied notice of any spill, asserted plaintiff had severe pre-existing degenerative arthritis and further argued that plaintiff had fallen on 12 different occasions before his arthroscopic surgery. Plaintiff responded by maintaining that he was asymptomatic prior to his first fall and that all subsequent falls were due to his weakened condition.

Deft tractor-trailer driver Gary Sucku made a left turn from northbound Archer into the Dolphin Cartage truckyard near Knox.
